Thanks for using NEX! Here we describe how we collect, use, and handle your information when you use our websites, software, hardware, and services ("Services").

What we collect

We collect the following information to provide, improve, and protect our Services:

Account

We collect information about you and your organisation as you register for an account, create or modify your user profile, make purchases through, use, access, or interact with NEX Services. Information we collect includes:

  • Contact information such as name, email address, mailing address, and phone number
  • Billing information such as credit card details and billing address
  • User profile information such as username and site settings
  • Preferences information such as notification and marketing preferences

You may provide this information directly when you enter it in NEX Services.

In some cases another user (such as an Account Manager) may create a user account on your behalf and may provide your information, including personal information (most commonly when your organisation requests that you use our products). We collect information under the direction of our customers and often have no direct relationship with the individuals whose personal data we process. If you are an employee of one of our customers and would no longer like us to process your information, please contact the organisation Account Manager. If you are providing information (including personal information) about someone else, you must have the authority to act for them and consent to the collection and use of their personal information as described in this Privacy Policy.

Products & Services

Our products and services are designed to acquire data from various sources (for example building power meters, weather feeds, high-level-interfaces) in order to provide detailed monitoring and reporting accessible from multiple devices. To make that possible, we acquire, store, process, and transmit data - like readings, settings, and alerts - as well as information related to it.

Usage

We collect information related to how you use the Services, including actions you take in your account (like viewing data and editing site preferences). This guides improvements to the Services.

We also collect information from and about the devices you use to access the Services. This includes things like IP addresses, the type of browser and device you use, the web page you visited before coming to our sites, and identifiers associated with your devices.

Cookies and other technologies

We use technologies like cookies and pixel tags to provide, improve, protect and promote our Services. For example, cookies help us with things like remembering your user details for your next visit, understanding how you are interacting with our Services, and improving them based on that information. You can set your browser to not accept cookies, but this may limit your ability to use the Services.

Who we share it with

We share information as detailed below, but we won't sell it to advertisers or other third parties.

Others working for NEX

NEX uses certain trusted third parties (for example, providers of services) to help us provide, improve, protect, and promote our Services. These third parties will access your information only to perform tasks on our behalf in compliance with this Privacy Policy, and we'll remain responsible for their handling of your information per our instructions.

Other users

Our Services display information like your name and email address to other users under the same NEX Account. Certain features may also let you make additional information available to others.

Other applications

You can also give third parties access to your information and account - for example, via NEX APIs. Just remember that their use of your information will be governed by their privacy policies and terms.

Law & order

We may disclose your information to third parties if we determine that such disclosure is reasonably necessary to:

(a) comply with the law;

(b) protect any person from death or serious bodily injury;

(c) prevent fraud or abuse of NEX or our users; or

(d) protect NEX's property rights.

Business Transfers

We may share or transfer your Information (including your personal information) in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company. You will be notified via email and/or a prominent notice on the NEX Services of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.

Aggregated or Anonymised Data

We may also share aggregated or anonymised information that does not directly identify you.

How we store, process, and transmit data

Security

NEX implements security procedures to help protect Your Data from security attacks. However, you understand that use of the Hosted Services necessarily involves transmission of Your Data over networks that are not owned, operated or controlled by us, and we are not responsible for any of Your Data lost, altered, intercepted or stored across such networks. We cannot guarantee that our security procedures will be error-free, that transmissions of Your Data will always be secure or that unauthorised third parties will never be able to defeat our security measures or those of our third party service providers.

Retention

We'll retain information you store on our Services for as long as we need it to provide you the Services. If you delete your account or user profile, we may also delete this information. But please note:

(a) there might be some latency in deleting this information from our servers and back-up storage; and

(b) we may retain this information if necessary to comply with our legal obligations, resolve disputes, or enforce our agreements.

You can access your personal information by logging into your user profile.

Where we store, process, and transmit data

To provide you with the Services, we may store, process, and transmit information in Australia and locations around the world - including those outside your country. Information may also be stored locally on the devices you use to access the Services.
